Virtual Try On Information Policy

Laura Geller, a member of the AS Beauty LLC family of brands, has instituted the following Virtual Try-On Information Notice (the “Information Notice”) related to your use of our virtual try-on feature (the “Virtual Try-On Feature”). Purpose

The purpose of the collection, storage, processing and use of personal information for the Virtual Try-On Feature is to provide You with a meaningful and efficient way to evaluate Laura Geller’s products for potential purchase and use. When you use the Virtual Try-On Feature, your information is processed in order to deliver a personalized virtual try-on experience to you. Please see “How it Works” below for more information.

How It Works

In order to use the Virtual Try-On Feature you must upload a selfie of yourself. Your selfie will be transmitted from your device to a central cloud-based server provided by our service provider. The Virtual Try-On Feature uses an algorithm to analyze the selfie to detect over 400 points on your face and key facial landmarks [(i.e., the location of your eyes, the center of your eyes, location of your mouth and nose, center of your face, etc.). This information is used to [analyze the image to calculate an estimate of your skin tone] [and digitally apply product to the correct areas]. [After inferring skin tone, the image is rendered and you will then be provided with access to your results (i.e., your nearest skin tone match). If you disagree, You can select from different options. After you make your selection, and, depending on answers you provide in response to some additional questions along with the results of the analysis, the Virtual Try-On Feature will suggest product(s).] Your image is not used to identify or verify the identity of any individual, but the result of the experience (picture with product applied) can be downloaded on your device.

Your Consent for Collection and Use of Personal Information About You

When you use the Virtual Try-On Feature, you specifically consent that:

• The Virtual Try-On Feature will temporarily collect, capture, possess, store, or obtain your image, and data obtained or created from your image (including the automated recognition of various facial landmarks), that might qualify as biometric data, biometric information, or a biometric identifier under various laws.
• Laura Geller may share, disclose, or disseminate information about you with any other affiliated company that is also a member of the AS Beauty LLC family of brands, as well as its service providers who help provide you with the Virtual Try-On Feature (such as the provider of the cloud-based services).

YOU UNDERSTAND THAT YOUR CONSENT TO THE USE OF YOUR PERSONAL INFORMATION AS PROVIDED ABOVE IS A PREREQUISITE TO YOUR USE OF THE VIRTUAL TRY-ON FEATURE. Of course you are free not to use the Virtual Try-On Feature if you do not desire to consent to the use of your image and related data for the purpose described in this Information Notice.

This Information Notice coexists with, supplements, and does not supplant, obviate, replace, or otherwise supersede or suspend any other policy applicable to your use of the Virtual Try-On Feature or Laura Geller’s website, including the Terms and Conditions of Use (which includes an arbitration agreement to resolve disputes and a class action waiver) and the Privacy Policy.

This Information Notice is subject to periodic updating. Laura Geller reserves the right to amend this Information Notice at any time, which amendments will further apply to your use of the Virtual Try-On Feature after their enactment.

Data Retention

The Virtual Try-On Feature does not store your selfie and related data generated by the algorithm used to analyze your selfie. All facial calculations and post-processing of the image happens within the user's device. No images are sent to a cloud-based server or saved.

If you share the result of your experience outside of the Virtual Try-On Feature (through native features available on your device), we are not involved in, nor responsible for, such sharing and no further personal information will be processed by Laura Geller.

Data Storage

Laura Geller and its service provider use a reasonable standard of care to store, transmit, and protect from disclosure any data used in the Virtual Try-On Feature consistent with the sensitivity of the data. However, no electronic data transmission or storage of information can be guaranteed to be 100% secure.

Disclosure

Laura Geller may share, disclose, or disseminate information about you with any other affiliated company that is also a member of the AS Beauty LLC family of brands, as well as its service providers who help provide you with the Virtual Try-On Feature (such as the provider of the cloud-based services). Laura Geller may also disclose personal information to comply with federal or state law, local law, municipal ordinance, or court order, including in connection with a validly issued warrant or subpoena, and as otherwise disclosed in the Privacy Policy.
